By accessing or using Crew by Sea ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

Description of the Service

Crew by Sea is an online platform that connects boat captains with crew members for sailing passages. We provide tools to post passages, search for crew, manage applications, and communicate with other users.

Eligibility

You must be at least 18 years old to create an account and use the Service. By registering, you confirm that you meet this age requirement.

Your account

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must provide accurate and truthful information when registering and creating your profile.
• You must notify us immediately if you suspect unauthorised access to your account.

Acceptable use

You agree not to:

• Post false, misleading, or fraudulent information about yourself or any passage.
• Harass, abuse, or harm other users.
• Use the Service for any unlawful purpose.

User content

You retain ownership of content you post on Crew by Sea (profile information, passage listings, messages). By posting content, you grant us a non-exclusive, worldwide licence to store, display, and distribute that content solely for the purpose of operating the Service. You are solely responsible for the accuracy and legality of content you post.

Safety disclaimer

Crew by Sea is a platform for connecting captains and crew. We do not verify the sailing qualifications, certifications, or experience of any user. You are solely responsible for assessing the suitability of any captain or crew member before participating in a passage. Sailing at sea carries inherent risks, and you agree to take full responsibility for your own safety and the safety of those under your charge.

Intellectual property

All software, design, logos, and content created by Crew by Sea are our property or licensed to us. You may not reproduce, distribute, or create derivative works from our content without written permission.

Termination

We reserve the right to suspend or terminate your account at any time if we believe you have violated these Terms of Service or if we are required to do so by law. You may close your account at any time by contacting us.

Limitation of liability

To the maximum extent permitted by applicable law, Crew by Sea shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the Service. Our total liability to you for any claim shall not exceed the amount you paid us (if any) in the 12 months preceding the claim.

Governing law

These Terms of Service are governed by the laws of Texas and the United States. Any disputes shall be subject to the exclusive jurisdiction of the courts of Texas and the United States.

Changes to these terms

We may update these Terms of Service from time to time. We will notify registered users of material changes by email or by a prominent notice on the Service. Continued use of the Service after changes constitutes acceptance of the new terms.
